Man seriously injured in construction accident in Quincy

A man was seriously injured in Quincy yesterday afternoon
while working at a National Grid construction site. The unidentified man was struck by a backhoe according to a report in the Patriot Ledger.

A Quincy policeman confirmed that someone was involved in an accident at the site and said that he had "crushing type" injuries on the left side of his person. He was transported to Boston Medical Center after an officer who was near the scene was alerted to the accident.

Riley Brothers Construction is reportedly doing subcontracting work for National Grid and is likely the man's employer. OSHA and state police are investigating.

New studies for competing treatments funded by government

A recent article in The New York Times says that the Obama administration is funding studies of competing treatments of conditions like back pain, heart disease, and prostate cancer.

According to the article, 15 years ago federal officials issued guidelines regarding competing treatments and it became a political battle between the Republican party, the federal Agency for Healthcare Research and Quality, and a medical device maker called Medtronic, who blocked the release of the study and tried to eliminate the agency's funding.

The federal government plans to spend $1.1 billion over the next few years to conduct studies comparing the effectiveness of treatments and these studies will be published so patients and their doctors can discuss treatment options, said the Times.  They will hold hearings later this year to begin asking people to share their stories about the effectiveness of different treatment options, and these will be published so that doctors and patients can compare treatment options and choose the best one, according to the Times.

Doctors research immune therapies to fight cancer

A new method of fighting cancer is getting support from some doctors.  According to an article in The Boston Globe, doctors are researching how to use the body's own immune system to fight off cancer cells.

This immune therapy approach is called a vaccine, although it is used to treat cancer, not to prevent it.  According to the Globe, experimental vaccines were presented at the American Society of Clinical Oncology's annual meeting and were targeting prostate, melanoma, and neroblastoma cancers.  The Globe article said the doctors at the cancer conference said they had found a vaccine that was able to stop a form of lymphoma from getting worse for more than a year, but they couldn't predict how long this would last.  The researchers are not calling this vaccine a cure for cancer, but a possible option in treatment, according to the article,

The oncologists at the annual meeting described the immune therapy as guerilla warfare, the Globe said.  They explained that the body's immune system has problems identifying cancer cells because the cancer cells are the body's own cells, not foreign cells like flu cells and so the immune system has trouble recognizing a problem and doesn't immediately attack the cancer cells, according to the article.

Some health insurance isn't enough

Even people who have health insurance coverage are having problems with rising costs, to the point where it is causing some people to go bankrupt because they can't pay their medical bills, according to a new article in The New York Times.

According to the Times, three quarters of people who had to file bankruptcy because of high medical bills had health care coverage; it just wasn't enough. Federal legislators are working on finding a solution to the health care crisis.

The Children's Defense Fund httpis collecting facts about the number of children who are uninsured, as well as those who are underinsured. Their statistics currently indicate that there are nine million children without health insurance. Those same statistics show that millions more are under-insured.

The Children's Defense Fund campaign is called Speak Now for Kids in Health Reform. The campaign is urging parents, family members, health care providers and other advocates to tell Congress why children matter in health reform – through stories, photos and videos. They want parents to tell Congress their own health care stories to put a human face on this debate about major health care reform.

Corporations and Children's Defense Fund promote wellness health care

A New York Times article describes the efforts of corporations and businesses who are encouraging their employees to adopt healthier lifestyles in an effort to curb rising healthcare insurance costs.  According to the article, unhealthy employees cost employers money because they require more health benefits and medical services.

Wellness programs make more sense for employers because they concentrate on diet, nutrition, and exercise programs that will keep employees healthier.  According to the New York Times, three quarters of the money the nation spends on health care is for chronic health conditions.  By targeting employees' behavior, employers are hoping to cut their own costs for health care.  By filling out a survey or questionnaire, employees can understand their health risks and develop an individualized health care plan.  As they concentrate on healthy lifestyles like diet and exercise they will become healthier employees and cost their employers less in the long run, according to the New York Times article.

The Children's Defense Fund is advocating children's right to health care in the current debate about health care reform, and hoping that the 5-6 million uninsured children will be covered.

How Inadequate Mall Security Affects Teens

Inadequate mall security has a dual effect on teenagers, a steady and profitable demographic sector of shopping center patrons. While the majority of teens travel through malls in groups, those who shop alone are especially vulnerable to robbery, carjacking and sexual assault. Teens who are injured in a mall crime may recover damages in a premises liability lawsuit.

Inadequate security that makes older patrons wary, however, can wrongfully cast teenagers as the troublemakers simply because they do congregate in groups. Seniors who might feel safe if security patrols were visible blame teens rather than mall management. Property owners are liable to some degree for preventing personal injury of their customers.

How Inadequate Mall Security Affects Women

As budget cuts lead to inadequate mall security, women may be most affected by increased violent crime. Every age group holds prime targets for criminals, who use relaxed security as an opportunity to successfully commit crime and escape identification. Seniors are vulnerable to robbers. Children are used as hostages to force carjacking or ATM cash withdrawals. Women alone are raped and assaulted.

Cameras that aren't monitored and diminished foot patrols may be all it takes to make a mall environment more attractive to a serial criminal. Women who are injured in such circumstances should contact a personal injury attorney, who may be able to prove negligent security in a premises liability case against the mall.

Lawsuits Challenge Inadequate Mall Security

Sometimes inadequate mall security becomes an "accomplice" in violent crimes against shoppers. Premises liability law holds mall owners responsible for customer injuries, in some cases. Property owners or managers who allow a dangerous environment to grow out of lax security policies may pay for their negligence in civil court.

Security includes making criminal incidents known, so that the public can take precautions of their own. Take the case of a successful 2003 lawsuit against a major upscale mall chain. An employee who was raped in the parking lot found that management had failed to disclose similar recent attacks. Her attorney secured a $3 million court award for damages.

Crowd Control and Inadequate Mall Security

Inadequate security at malls leaves shoppers vulnerable to dangerous crowd activity, serious personal injury and death.
When the customers themselves become a danger to others, the property owner has a legal responsibility to step in and improve security measures.

For instance, after the 2008 trampling death of a Wal-Mart employee by crowd of shoppers, the chain swiftly composed a crowd-management plan. Retail property owners, who are required by premises liability law to address known customer safety issues, such as the highly publicized fatal incident, will be held to a higher standard of care by future courts. If you are injured by uncontrolled shopping center crowds, contact a premises liability lawyer.

New study shows insured kids will help economy

According to UPI, a recent study indicates that there is evidence that providing health insurance for the nine million children currently uninsured would have a major economic impact. The UPI article stated that the researchers said that providing health insurance for those uninsured children would result in healthier children, more productive adults, and substantial economic benefits for the country.

For more information, go to: http://www.bakerinstitute.org/publications/HPF-pub-HoShortUninsuredChildren-060309.pdf/view.

The Children's Defense Fund has collected facts about the number of children who are without health care coverage in this country—nine million children are uninsured, millions more are under-insured, and health care costs are rising making it difficult for parents to afford health insurance.

The Children's Defense Fund is conducting a campaign urging all Americans, and partnering with several civil rights organizations, to become involved in the discussion of health care reform and to give children a voice in this debate. The campaign is called Speak Now for Kids in Health Reform and urges parents, family members, health care providers and other advocates to tell Congress why children matter in health reform – through stories, photos and videos.

Surgeons working too long

A recent Boston Globe article reported that an national accreditation team discovered that junior surgeons at Massachusetts General Hospital were working longer hours than was safe for patients. The study was done by the Accreditation Council for Graduate Medical Education. According to the report, the fact that residents were sometimes working seven days in a row violated patient safety rules, which could lead to fatigue-related mistakes possibly jeopardizing the health of patients. The national accreditation organization gave the hospital until August 15th to correct the situation, but the Globe reports that a hospital spokesperson said they have already cut back on resident hours.

The Globe article said that other teaching hospitals have also been cited--five to 10% of teaching programs were cited for similar violations last year. According to the Globe, Dr. Matthew Hutter, the Mass. General surgeon who was lead author of the study, said he interviewed residents before and after the safety rules were adopted and he found that the residents reported less fatigue and burnout. A spokesperson for the Institute of Medicine said that their intention is to make hospitals a safe place for patients, according to the Boston Globe.

Massachusetts Code on Security at ATMs

Security at ATMs is getting a boost, thanks to civil lawsuits demanding high sums from banks and other property owners who are found liable for customers' damages. Personal injury attorneys in Massachusetts use precedent-setting cases in proving negligent security as a factor in ATM crimes.

The Massachusetts Office of Consumer Affairs and Business Regulations supervises minimum security compliance among ATM operators.

Banks are required to follow federal laws. Non-bank ATM owners must:
  • Carry sufficient fidelity and liability insurance
  • Maintain security for employees and consumers
  • Report thefts and assaults to law enforcement and the state banking commissioner

A Massachusetts premises liability lawyer can help you file a negligent security lawsuit.

When you are interviewing personal injury attorneys ask critical questions, like: how long have you been practicing; what is the largest settlement or verdict you've obtained, and do you have experience with this type of case? Improving Security at ATMs

Inadequate ATM security is the focus of more and more banks and non-bank ATM owners. Many are stepping up precautions on the premises and even installing safeguards directly on the machines.

If you were the victim of an assault at an ATM, you may not have noticed its 9-1-1 hookup.

This emergency button on some ATMs connects directly to police. When the call is made, a speaker and microphone hidden in the machine allow dispatchers to hear what is going on within a 20-foot radius.

Your premises liability attorney can find out if the bank made this crucial security addition before or after your violent incident.

Lawsuits Encourage Better Security at ATMs

When inadequate security at ATMs results in injuries,
lawsuits remind the responsible parties of their duty to customers. Profits resulting from business practices should be enough incentive to perform their moral and legal duty, but sometimes more encouragement is needed.

Consider the 2004 New Jersey case of two women who were sexually assaulted at an automated teller machine on bank premises. Their negligent security lawsuit resulted in a $1.8 million settlement. Banks and other ATM operators are finding that it is more cost-effective to invest in better security than to deal with personal injury or wrongful death lawsuits.

Crime Patterns and Premises Liability

Premises liability attorneys that represent ATM operators know the statistics on violent crime at cash machines. They pass the news along to bank and other ATM owners. This should allow site managers to tailor ATM security to crime patterns, but most never do.

Most robberies and personal injuries at ATMs:
  • Happen after dark
  • Occur after 7pm and before midnight
  • Affect only a possible 10 percent of ATM transactions

If you were injured in a violent crime at a banking machine, a personal injury or premises liability lawyer can find out whether security was inadequate. The property owner may be responsible for your medical and related expenses.

Armed Robbery at ATMs

Armed robbery at ATMs becomes a premises liability issue when property owners fail to install minimum security precautions.
An emotional robber can be provoked into causing serious personal injury, as evidenced by recent ATM shootings.

ATM operators may know who the perpetrators are likely to be and how they victimize cash customers. Yet sometimes they fail to address the facts and improve nearby security. Statistics show that most robberies are committed by lone criminals who wait within about 50 feet of a machine. Mainly males, 24 years old or less, they display a gun or claim that they will use one.

Victims of ATM crimes can sue property owners in court.
