Tips on Filing a Wrongful Death Claim after a Child’s Death

A child's death from a water-related injury is a tragic occurrence that can be overwhelmingly difficult for a parent to face, particularly when the death is a result of negligent acts by another person. Water-related accidents that cause fatal child injuries often warrant a wrongful death lawsuit filed on behalf of the deceased child.

A wrongful death lawsuit can be an intimidating process, but there are ways to make the process a little easier. Here are a few helpful pointers when filing a wrongful death lawsuit:

  • Work with your wrongful death attorney to gather necessary evidence or witnesses, including expert witnesses and those who were present at the time of the accident.
  • Do not neglect or ignore your feelings of grief. The trial will likely bring back many memories of your child and it is important to work through the complicated emotions of grief.
  • Talk to a counselor, spiritual advisor or local support group.
  • Be prepared to take prompt action on the claim as Massachusetts law imposes a statute of limitations for wrongful death lawsuits.
  • Know that by holding negligent parties responsible for their actions, you are fighting for the rights of your deceased child

Mother Charged in Baby’s Bathtub Drowning

The Volusia County Sheriff's Office's has charged Christal Giachetti, 30, with aggravated manslaughter in the death of her baby, 4-month-old Trenton Giachetti.

Trenton drowned in the family bathtub.

Giachetti is accused of causing her baby's death through "culpable negligence" by not providing proper supervision while Trenton was in the bathtub.

Family members paint a picture of a mother struggling with parenting and drug abuse. She gave several stories to police, who found evidence of drug use, including a hypodermic needle and spoons with a white crystal substance on them.

Christal Giachetti was picked up in New York on May 8, 2009, where she was held on a $150,000 bond.

Trenton's death is a tragedy that could have been avoided. However, some accidental bathtub injuries and deaths are truly unintentional or happen because of faulty products.

Children are Hurt in Bathtub Accidents

Each year, 43,600 children are injured in slips, trips, and falls in home bathtubs and showers. That means almost 120 children are injured at home each day in slip and fall accidents.

According to a report by the
American Academy of Pediatrics, the largest number of bathtub injuries involved children 2 years of age. In fact, children under age 4 accounted for 54.3% of the injuries.

Experts agree that even if parents are hyper-vigilant in watching their children while they are in the bathtub or shower, child drowning accidents will still occur.

Manufacturers of bathtubs could make bathtubs safer by using non-slip surfaces and sides with grip bars
. In fact the AAP study states, "The incidence of these injuries may be decreased by increasing the coefficient of friction of bathtub and shower surfaces."

Dr. David L. Katz, director of the Prevention Research Center at Yale University School of Medicine, finds it alarming that there is such a high number of children injured severely enough in bathtub accidents to go to the emergency room. "Manufacturers need to go back and look at the current standard for slip resistance and strengthen that criteria," he said on Medicine.net.

Toddler Bucket Accidents: Avoid the 5 Gallon Bucket

Buckets filled with water or other liquids are a natural source of curiosity for toddlers

The Consumer Product Safety Commission, or CPSC, says, "Of all buckets, the 5-gallon size presents the greatest hazard to young children because of its tall, straight sides and weight, even with just a small amount of liquid. At 14-inches high, a 5-gallon bucket is about half the height of a young child."

The stability of the bucket combined with the height makes it next to impossible for top-heavy infants and toddlers to get free from the bucket if they fall in head first. Child drowning accidents can happen quickly in just a small amount of water. In fact, this can happen in the time it takes you to walk to another room and grab the mop.

Between 1996 and 1999, 58 children under age 5 drowned in 5-gallon buckets, according to the commission.
If you have 5 gallon buckets at home, get rid of them and use smaller buckets that are safer for homes with babies and toddlers.

If your baby or toddler has already had a bucket accident or bucket drowning, contact an experienced personal injury attorney to discuss your case and the options you may have. Preventing childrens boating accidents

More than 70 million people will be enjoying their boats this summer. To make it a safe and fun time, parents should really make sure their children wear a life jacket—the most important safety measure they can take. Nine out of ten people who drown each year were not wearing life jackets, according to the North American Safe Boating Campaign, and the Center for Disease Control and Prevention (CDC).

In addition to drowning, boating accidents can result in trauma, hypothermia, carbon monoxide poisoning, and other life-threatening conditions.

In addition to requiring all people on the boat to wear a life jacket, and not having alcohol on board, parents can also take part in a boating education course. Many boating accidents happen because the boat driver does not understand how to operate the boat or operates the boat recklessly or too fast.

An educational boating course can provide operating instructions and boating safety techniques similar to a car education class. The U.S. Coast Guard provides a free service called the Vessel Safety Check where volunteers check the boat's equipment and provide training about boat safety procedures.
