Lawsuits filed in trolley accident


Two women injured in the May 8 trolley accident have filed lawsuits against the trolley operator, Aiden Quinn, and the MBTA.
The women, represented by two different attorneys, sustained injuries in the accident that occurred while the trolley operator was texting his girlfriend.

Jennifer Levi, was five months pregnant at the time of the accident and injured her wrist. She has not delivered her baby yet, but is making a claim for negligent infliction of emotional distress. The fetal heartbeat of the child was not detected by emergency personnel for hours after the crash.

Rebecca Bishop fractured her pelvis in the trolley accident and only recently returned to her job - albeit in a "light duty" status, according to an article in the Boston Herald.

The lawsuits were filed in Suffolk Superior Court in June.
Criminal charges were filed against Quinn earlier this month.

Aiden Quinn charged in Boston trolley accident


The driver of the Green line trolley that crashed near Government Center in Boston on May 8 has been criminally charged under a 100 year old statute for his role in the incident. Aiden Quinn, 24, admitted to authorities that he was sending text messages to his girlfriend at the time of the accident. 

An investigation determined that Quinn was likely distracted by his texting and didn't pull an emergency brake until the trolley was 8 feet behind another trolley that was at a stop in its path.

The accident injured 62 people and caused $9 million in damage, and the destruction of three trolley cars. Most of the victims suffered minor injuries however several suffered serious injuries, including one woman who may not walk again.

The accident gave rise to a public outcry for legislation that would prohibit texting while driving. While lawmakers consider such measures, the Suffolk District Attorney used a 100-year-old law - "gross negligence by a person in control of a train" to bring criminal charges against Quinn.

The MBTA and Aiden Quinn could face victims in civil court, as well, if lawsuits are filed by those injured in the trolley crash.

Massachusetts cell phone prohibition bills to be reviewed by legislature


Lawmakers who sit on the Legislature's Transportation Committee will review 15 bills tomorrow that concern the prohibition of making cell phone calls or text messaging while driving.

Public support for such a ban has been building, particularly since Aiden Quinn, a MBTA operator, caused a trolley accident after he admittedly was distracted from driving while sending text messages to his girlfriend.

The House chairman of the Transportation Committee, Representative Joseph Wagner, supports legislation that prohibits texting while driving and using a cell phone while driving without a hands-free device.

Boston Trolley Accident Examined by Grand Jury

A grand jury has convened in Suffolk County to review evidence and consider charges against a man who was texting his girlfriend when he crashed a trolley on May 8. The accident severely damaged three trolleys and injured almost 50 people. Aiden Quinn, the trolley's operator, has been fired from the MBTA since the accident. According to a story in the Boston Globe, Quinn's attorney, Michelle Menken, is not surprised by the charges, which authorities hinted at early in their investigation.
