Melanie’s Law Increases the Use of Breathalyzers


Melanie's Law seeks to reduce the pain and suffering caused by drunk driving accidents.

"When Melanie's Law was enacted in October 2005, it was meant to curb repeat drunk-driving offenders, increasing the penalties for a conviction and for refusing to take a Breathalyzer test," according to MetroWest Daily News. So far it appears to be working, at least partially.

The law places limits on drunk drivers and provides consequences for drivers who refuse to cooperate with police when they are suspected of drunk driving.

Any driver who refuses to take a Breathalyzer test on the first offense loses their driver's license for 180 days. The second time a person refuses to take the test, they lose their license for 3 years. The consequence becomes 5 years on the third offense and a lifetime suspension on the fourth offense, the article reports.

Because of the law, more and more people are agreeing to take the breathalyzer test. Additionally, the reality that they might have to take the test if stopped encourages drivers who drink to seek alternate transportation.

Two die in Wednesday morning crash on I-495


The driver and passenger riding in a Honda CRV were killed today in an accident on Interstate 495. The accident took place around 6:30 a.m. on I-495 in Westford, near Exit 32.

According to the Boston Globe, the Honda was traveling southbound when the vehicle veered to the right, struck another vehicle, swerved to the left across the highway median, and passed under a tractor trailer before being hit by a vehicle headed northbound.

Drivers of two other vehicles were seriously injured and taken to Emerson Hospital. The occupants in the Honda were taken to Lowell General Hospital and pronounced dead. Their names have not yet been released.

Portions of the highway were closed until 9:30 a.m., causing major delays during the morning rush hour.

Three car accidents in Yarmouth last night


Emergency personnel in Yarmouth were busy last night attending to three car accidents that occurred between midnight and 2:30 a.m.

The Cape Cod Times reports that the first accident took place on Route 6, between exits 8 and 9. There were no injuries sustained in the crash which was described as a minor "fender-bender."

The second accident occurred at approximately the same time at the intersection of Winslow Gray Road and Long Pond Drive. Four people were transported to Cape Cod Hospital with non-life threatening injuries.

A third accident took place at 2:30 a.m. when a driver hit a utility pole. The driver was injured and taken to Cape Cod Hospital.

No information has been released regarding the cause of the accidents or charges that may be filed related to the crashes.

Methuen police officer disciplined for July 4 crash


A police officer from the Methuen Police Department has been disciplined for his role in a crash that took place in the early evening hours on July 4.

Officer Matthew Tarness
crashed a new $37,000 Dodge Charger into a passenger van carrying ten people as he rushed to respond to the scene of a domestic abuse call. According to the Department's police chief, Tarness failed  to sufficiently stop at the intersection at Madison and Westland streets.

Paul Destine
was driving the Chevy van that Tarness's cruiser collided with in the accident. There were five adults and four children in the van at the time of the crash and five of them were transported to local hospitals with minor injuries. Tarness, and his passenger, Reserve Officer David Souther also sustained minor injuries in the accident.

The Dodge Charger was totaled in the accident. No criminal charges or serious injuries occurred as a result of the domestic disturbance call that Officer Tarness was racing to when he hit the van.

Dangerous intersection in Mattapan


The intersection of River Street and Cummins Highway in Mattapan, Massachusetts, was the scene of two accidents yesterday.

The first accident involved a police cruiser and a car colliding in the early morning hours on Sunday. Two police officers went to the hospital with non-life threatening injuries. A citation was not issued in the crash.

The second accident occurred after 11:00 a.m., when a Honda Civic pulled out in front of a motorcycle. The driver of the Civic was unharmed, but the motorcyclist was transported to Brigham and Women's Hospital with non-life threatening injuries.

Witnesses of the accidents told reporters from the Boston Globe that the intersection is known to be a dangerous one and that accidents are not uncommon.

Man injures motorist, tries to flee with car on fire


Carter Gillenwater, 53, of Roxbury, was traveling southbound on I-93 last night when he allegedly caused an accident and then tried to flee the scene. Gillenwater was returning from a trip to Salem, New Hampshire, when police say he hit some construction cones in the road, rear-ended another car, stopped momentarily and then kept driving. Gillenwater's hood was severely damaged and his car was on fire as he drove away from the accident in his 1997 Lexus ES 300.

According to the Eagle Tribune, witnesses called the police who tracked down Gillenwater and arrested him near Route 62. His car had come to a stop in the right lane of the roadway. Local firefighters extinguished the car which was still on fire.

Matthew Clemente, 30, was in the car that Gillenwater struck and suffered back and neck injuries. He has been released from the hospital.

Gillenwater will be arraigned today in Woburn District Court on the following charges:

Woman hit by firetruck in Lawrence


A three-car accident took place on Lawrence Street yesterday at 2:10 p.m. when a woman failed to yield to a firetruck which was responding to an emergency on Essex Street. According to the fire chief, the woman was talking on her cell phone at the time of the accident. The pumper truck clipped her car and then she hit a parked car on the street.

The car the woman was driving sustained damage to the front and rear passenger side of the vehicle and the parked car had damage on the driver's side. The firetruck was damaged on the front bumper.

No injuries were reported in the incident.

Patrolman cited for accident causing pedestrian’s injury


A Falmouth policeman has been cited for causing a two-car accident that resulted in serious injuries for a nearby pedestrian. Michael Simoneau
, was following another police cruiser responding to a domestic disturbance call when he rear-ended the cruiser and caused it to strike pedestrian, James Eldredge.

The accident took place last month on Sandwich Road around 11 p.m. Eldredge was transported to an area hospital after the crash and reportedly required a medically induced coma.

Simoneau has been cited with "following too closely"
in connection with the accident. Eldredge has hired an attorney to represent him in the matter.

Accident in Taunton injures one


A squirrel was blamed by a driver who wrecked his car in Taunton early Sunday morning.
John Moses, 23, said that he was driving at 12:30 a.m. on Sunday on Caswell Street when he lost control of a 2002 Honda Accord after trying to avoid a squirrel in the road. Moses hit a telephone pole and his car reportedly slid on its side for 75 feet after the collision. The vehicle came to a stop, wheels down.

Moses was transported to Morton Hospital and Medical Center following the crash.

Police have cited John Moses with "operating a motor vehicle so as to endanger."
Property damage from the accident includes the broken telephone pole, and damaged wires running from it to a house on the street. Investigators did not find any skid marks on the road, indicating that Moses may not have slowed prior to, or during, the crash.

Pedestrian hit in alleged road rage incident


A teenager from Kingston was injured on Sunday morning during an alleged road-rage incident as he was walking on West Grove Street in Middleboro.
The 19-year-old man was hit by a pickup truck driven by Brian Hennault, 22, of Middleboro.

The injured victim was transported to Morton Hospital and Medical Center and later moved to Boston Medical Center.

According to South Coast Today, Brian Hennault was charged with the following offenses after the accident:

Plainville accident injures one

, 22, was injured on Friday morning when she rear-ended a tractor-trailer in Plainville. The accident occurred around 1:12a.m. on Route 1 in Norfolk County.

Brevik, from Blackstone, was taken to Sturdy Memorial Hospital . Tomica Bosnjak, 49, was driving the tractor-trailer southbound on Route 1 at the time of the crash. Bosnjak was not injured in the collision, according to the Sun Chronicle.

Two injured in rollover crash in Yarmouth


Two women were injured in an early morning crash in Yarmouth yesterday, according to the Cape Cod Times.
Kristen Bess, 22, was driving a 2003 Ford Mustang when she lost control of the vehicle and it crashed into a guardrail, rolled over and came to a stop in woods near Route 6.

The accident occurred around 1:00 a.m. Bess's passenger, Lauren Wolf, 21, was critically injured in the crash,
according to the Cape Cod Times. Both women were transported to Cape Cod Hospital by emergency personnel, and Wolf was later moved to Boston Medical Center.

State police are investigating the cause of the accident and believe speed may have been a contributing factor in it.

Accident in Foxboro leaves one person injured


A rollover accident in Foxboro left the one man injured, and three passengers in need of a ride home after the driver swerved to avoid hitting a raccoon.
The accident took place around 1:15 a.m. in Foxboro on Route 1.

Emergency personnel responded to the scene and firefighters transported the injured male driver to Norwood Hospital for treatment. The driver and occupants of the vehicle had managed to extract themselves from it and were standing near it when firefighters arrived at the scene. The raccoon was sitting nearby, as well, according to an article in the Sun Chronicle.

According to State Farm Insurance, 1.5 million animal-vehicle collisions occur each year. An estimated one billion dollars in damage is caused by such collisions. Approximately 10,000 people are injured from these crashes and 150 people die annually. The company recommends that drivers maintain control of the vehicle and avoid swerving as accidents such as the one described above can occur.

Elderly man seriously injured after mistaking gas for brake pedal

, 84, of Falmouth, was seriously injured on Saturday in an accident in his backyard. He reportedly confused the gas and brake pedals and accelerated down an embankment and then drove 80 yards into the backyard of his home on Woods Hole Road.

Morris's car struck a tree and the left side of his vehicle and the car rolled onto the roof.
The elderly man was transported by helicopter to Brigham and Women's Hospital in Boston and was in good condition last night.

Six injured in multi-car collision in Centerville


Six people were injured in a two-car accident
in Centerville on West Main Street Thursday afternoon. The accident occurred near Route 28 shortly after 4p.m. when a car rear-ended another vehicle on the road.

According to the Cape Cod Times, the vehicle that was hit was a station wagon that contained a mother, grandmother and two small children. Occupants of both vehicles were injured with minor to moderate injuries. The children in the front vehicle were taken to the hospital for evaluation but had no apparent injuries.

All six were transported to Cape Cod Hospital for treatment and evaluation.

October is deadliest month on the roads


A study of accident statistics conducted by one researcher at the University of Michigan reveals that the fall is the deadliest time of the year to drive. Surprisingly, the autumn months beat out the chilly winter ones for fatalities caused by driving accidents. In contrast, March is the safest month of the year.

Michael Sivak, of the University of Michigan Transportation Safety Institute analyzed crash data from 1994 to 2006 for his report on seasonal death rates appearing this month in the Traffic Injury Prevention journal.

The longer hours of darkness and warmth of the fall are two factors that may be connected to the high accident rate in October.

Witnesses act quickly to prevent driver from fleeing scene of accident


Witnesses acted quickly to prevent Cathy Bergin-August from fleeing the scene
of an accident yesterday after she ran into a father who was putting his small child in the car. The unidentified dad was seriously injured after he was struck by Bergin-August and lay in the street with head injuries until emergency personnel arrived. Meanwhile, onlookers used their cars to keep the driver from completing her hit-and-run attempt.

The accident happened at 8a.m. at the intersection of Cambridge and Gordon streets. The man who was hit was in critical condition last night at Massachusetts General Hospital.

Bergin-August has a history of surchargeable offenses from accidents, as well as several license revocations in the last five years.
Her license was once again revoked yesterday following the accident.

She has also been charged with the following offenses and will be arraigned in Brighton District Court today:

, a retired East Bridgewater police officer, died last week after he and his wife, Judy, were in a motorcycle accident in Stoughton, Massachusetts, on July 6. The accident took place at approximately 7:11p.m. at the Canton and School Street intersection.

Mario Moretti
was airlifted to a hospital in Boston following the crash, and passed away the next day. Judy Moretti was in fair condition at a local hospital last week, according to the Taunton Gazette.

Moretti, 65, was the first motorcycle patrolman in East Bridgewater
and worked for that town's police department for 32 years. Moretti shunned foreign motorcycles in favor of a Harley-Davidson bike.

The Stoughton police are investigating the accident, however no charges had been filed as of Friday.

Veteran presumed dead in hit-and-run boating accident


A 29-year-old veteran from Methuen is presumed dead after a boating accident
on the Merrimack River last night. Juan Carlos Guzman, was boating with family members when a small boat struck their 22-foot vessel. According to his family, Guzman struck his head and flew approximately 20 feet into the water after the collision. Family members tried to search for him in the water, but visibility was only four feet and they could not locate him. He was not wearing a life jacket at the time.

The accident occurred at approximately 7:20p.m. Rescue workers searched the river for the man but suspended search efforts after dark. Guzman's family watched as divers looked for him in the river.

The father of four returned from his second tour in Iraq in 2006
and was working as an electrician, according to the Eagle Tribune.

Elderly driver charged in 4-year-old’s death


An 88-year-old woman has been charged with "motor vehicle homicide by negligent operation" after a June 13 accident that claimed the life of 4-year-old Diya Patel. Patel was crossing the street on her scooter in a crosswalk in Stoughton with her grandfather when Isle Horn hit her.

The charge handed down by a Norfolk County grand jury yesterday carries with it a maximum jail term of two and a half years.

The accident is one of many in the last two months that have involved elderly drivers and it caused an outcry by concerned members of the public and legislators who want to enact bills that would require senior drivers to retest at the Registry of Motor Vehicles more frequently.

Elderly woman hit by SUV on Fourth in “good” condition


An elderly woman hit by an SUV after a Fourth of July parade in Chatham is now in "good" condition according to a spokeswoman at the Brigham and Women's Hospital in Boston. Virginia Machie, age 81, was struck by an SUV driving by Troy Eldredge, 27, of Harwich.

Eldredge hit the woman and then ran over her on Post Office Road after the July 4th parade this past weekend. According to an article in the Cape Cod Times, the Cape Cod Accident Reconstruction Team went to the scene of the accident yesterday to further investigate the accident. A final report should be completed within the next day, and police will consider whether charges should be filed against Eldredge.

Three car accident at Sagamore Bridge sends drivers to hospital


Two drivers were injured in a three car accident
yesterday at the end of Sagamore Bridge in Bourne, Massachusetts. According to the Cape Cod Times, the accident occurred at approximately 3:30p.m. when a SUV and a car collided head-on.

, age 57, of Monument Beach, and Emilio Petrillo, age 40, of Norwood, were transported to Jordan Hospital with non-life-threatening injuries.

Southbound traffic on Route 3 was delayed by the accident, but the bridge and the road remained open during the event.

It is unclear how the third car was involved in the accident or who police have cited for causing the crash.

Senior driver charged in Wal-Mart accident


Louis Vesprini
of Peabody, Massachusetts, has been cited with driving to endanger after injuring seven people when he crashed into a Wal-Mart storefront in Danvers on June 2. Vesprini, age 93, will be summoned to Salem District Court once a court date is scheduled. A magistrate judge will decide whether to proceed with the charge. If convicted, Vesprini could face two years in jail.

Three store employees, a woman and her 1-year-old baby, and Vesprini's wife were injured in the accident.
A police investigation revealed that Vesprini drove through concrete pillars located in front of the store, and traveled as far as 40 feet into the interior of Wal-Mart.

Melanie’s Law enables seizure of drunk boater’s property


Yarmouth
police took possession of habitual offender, Jeffrey Daluz's, boat this past weekend after he was arrested for "operating a boat while intoxicated" on Saturday night. Daluz, 53, was issued the citation by Yarmouth natural resources officers who spotted him driving the boat into a restricted area that had been marked off for the Fourth of July fireworks display.

According to an article on Cape Cod Online, Daluz is prohibited from driving on land due to numerous alcohol-related convictions, but there are no similar laws that suspend boat operating privileges.

Saturday night's arrest marks the man's eighth arrest for operating a boat while intoxicated.

While there is no legislation in place to suspend Daluz's boating operation privileges, under Melanie's Law, a District Attorney can seek forfeiture of a motor vehicle for any defendant convicted of a 4th or subsequent alcohol-related driving offense.

Daluz has five previous convictions for alcohol-related offenses.
