The driver of the Green line trolley that crashed near Government Center in Boston on May 8 has been criminally charged under a 100 year old statute for his role in the incident. Aiden Quinn, 24, admitted to authorities that he was sending text messages to his girlfriend at the time of the accident.
An investigation determined that Quinn was likely distracted by his texting and didn't pull an emergency brake until the trolley was 8 feet behind another trolley that was at a stop in its path.
The accident injured 62 people and caused $9 million in damage, and the destruction of three trolley cars. Most of the victims suffered minor injuries however several suffered serious injuries, including one woman who may not walk again.
The accident gave rise to a public outcry for legislation that would prohibit texting while driving. While lawmakers consider such measures, the Suffolk District Attorney used a 100-year-old law - "gross negligence by a person in control of a train" to bring criminal charges against Quinn.
The MBTA and Aiden Quinn could face victims in civil court, as well, if lawsuits are filed by those injured in the trolley crash.
