Man Accused of Punching Marine Over Dog Charged with Manslaughter

July 16, 2009 - Abington – Michael McGunigle, the 49-year-old man who allegedly punched former Marine Brain Cherry during a dispute over a barking dog, is now facing Manslaughter charges in connection to Cherry’s death.

McGunigle was previously charged with assault after striking Cherry when the former Marine complained that McGunigle’s dog as barking too loudly and lunging at passers-by, and should be further restrained. Cherry struck his head on the pavement after McGunigle punched him and later died at Massachusetts General Hospital from severe brain injuries.

The results of Cherry’s autopsy prompted the Plymouth district attorney’s office to upgrade the charge from assault to Manslaughter. McGunigle turned himself in to authorities and was ordered held on $50,000 cash bail, according to new reports.
