Environmental Restoration Services Corporation (ERSC) has been cited by Massachusetts Attorney General Martha Coakley’s office due to the company’s careless and hazardous removal of debris that contained asbestos at a construction site in Gardner. Based in Lawrence, ERSC is led by disbarred attorney Jorge Elias, 64 of Salem. According to The Eagle Tribune, the Attorney General has filed a suit against the company for civil penalties stemming from ERSC’s actions that violate the Massachusetts Clean Air Act.
In the complaint filed this past Tuesday, the AG alleges that in June of 2009 ERSC illegally removed debris that contained asbestos from Gardner’s Senior Center by not following the proper protocol with such a removal. The Senior Center was undergoing a renovation at the time and ERSC, which is licensed in asbestos removal, was hired for the job. ERSC, however, failed to secure approval in removing the debris containing asbestos from both the Department of Environmental Protection (DEP) and the consultant for the City of Gardner.
ERSC reportedly dumped asbestos-containing tiles and other debris from the Senior Center into a roll-off open top container, which was located in the parking lot on site. The company failed to cover or in any way fasten the container securely. The AG stated that this action put the community at risk, as there are serious health issues associated with asbestos. ERSC has been in trouble with the law before with violating asbestos removal laws and paid a $3,000 fine in 2009 for another project located in Westfield. After paying the fine, ERSC was placed on probation for 2 years.
