August 5, 2009 – Fitchburg – The family of Preston Johnson, the man who was fatally shot by state trooper Donald Gray in 2005, has reached a settlement after filing a federal wrongful death lawsuit against both the trooper and his department.
A lawyer representing the Johnson family told reporters that the wrongful death lawsuit was settled before the trial, which was scheduled to begin on Monday, according to reports.
Johnson was shot in the back of the head by Gray during a police pursuit. The officer told police he had opened fire on Johnson because Johnson’s vehicle was moving and he felt threatened at the time.
Donald Gray’s attorney told reporters that Gray had been cleared of criminal wrongdoing, but decided to settle with the family “because it was the fastest way to resolve the case.”
