Brain Injury to 14 Month Old Boy – $2.6 Million Settlement
Our client, a 14-month-old boy, suffered seizures and permanent brain injuries from being exposed to neurotoxins in a lotion made by a generic drug manufacturer in this product liability case.
What Happened
The child was taken to a healthcare clinic for treatment for a persistent rash on his stomach. The examining physician made a diagnosis that the child was suffering from scabies and prescribed a generic form of scabicide lotion whose active ingredient was a pesticide that was a neurotoxin.
The lotion did not have any warnings for pediatric use, which would have instructed that the lotion be used in minute quantities, if at all. The pharmacy filling the prescription gave the mother the lotion in a cough-medicine-size bottle with instructions to apply the lotion to the child’s body at bedtime.
The mother used the product nightly until the child began to experience seizures.
Injuries from the Accident
As a result of the neurotoxin exposure, the little boy suffered permanent brain injuries. His family sued the generic drug manufacturer, which settled for $2,600,000. The settlement will go to cover the medical costs for the boy and the recovery and living costs associated with his brain injury condition.
