A legal claim arises when your child is entitled to compensations for injuries and/or damages resulting from an accident. The two major contributing factors to this designation are determination of negligence and the scope of expenses and damages. In short, are the injury-related costs great enough to warrant a claim and is someone at fault?

Generally, in order to have the legal right to retrieve compensation for your child’s injury, that injury must be attributable to negligence. A person, people, corporation, or government may be negligent, and a party is determined to be negligent when in violation of a known rule or law.

For instance, if I run a stop sign and hit another car, I am a negligent party. If I am responsible for the care of your young child and I let him or her swim unattended in my swimming pool, I am a negligent party.
