What is the victims of drunk driving trust fund?

In March of 2002, legislation establishing the Victims of Drunk Driving Trust Fund (DDTF) was passed in Massachusetts. The enabling statute for the Fund states that grants will be “awarded to community-based programs in the commonwealth to provide counseling and support services to victims of accidents caused by persons driving under the influence of drugs or alcohol.”

Statistics on drunk-driving show that approximately 12,998 people are killed every year in drunk-driving accidents, and three out of every ten Americans will be involved in an alcohol-related crash at some time in their lives. The Victims of Drunk Driving Trust Fund is intended to support victims and their families who have suffered due to the criminal negligence of inebriated motorists.

Who contributes to the fund?

An assessment fee of $50 that goes towards the Trust Fund is charged to anyone who is convicted of operating a motor vehicle under the influence of intoxicating liquor, marijuana, narcotic drugs, depressants, or stimulant substances if they are:

  • Placed on probation
  • Granted a continuance without a finding
  • Plead guilty
  • Admit to a finding of sufficient facts

Who administers the fund?

The Massachusetts Office for Victim Assistance (MOVA) is charged with awarding and administering grants from the fund to qualifying organizations.  The Massachusetts Office for Victim Assistance is an “independent state agency devoted to upholding and advancing the rights of crime victims.”

The fund currently has approximately $1.8 million in assets. The fund generated more than $750,000 in its first year.
