Global Child Health Initiative

There is an intense and immediate need for health care in developing nations. A huge gulf exists between the health of the wealthy and that of the poor, and this gulf is increasing world-wide. The majority of the health issues and causes of death are preventable and treatable. According to the Global Issues website, one billion people lack access to health care. Sadly, 11 million children under age 5 die from malnutrition and preventable diseases each year. And 1.6 million people die from pneumococcal diseases (bacterium that causes infections like meningitis, pneumonia, and sepsis), the number one vaccine-preventable cause of death worldwide, and more than half of those victims are children. More than half a million, mostly children, died from measles in 2003, even though an effective immunization costs $.30 US dollars per person and has been available for over 40 years.

In an effort to train doctors about these global health issues that affect children, the Department of Pediatrics at Boston Medical Center inaugurated the Global Child Health Initiative within the Boston Combined Residency Program in Pediatrics (BCRP). “The goals of the initiative are: 1) to increase knowledge and awareness of global health issues among all residents, 2) to provide specialized knowledge, skills, and mentorship to residents with career interests in Global Child Health, and 3) to provide high-quality opportunities for meaningful international clinical experiences,” according to the website for the Global Child Health Initiative. For more information, go to http://www.bmc.org/pediatrics/special/global.

Teen Charged in Fatal Crash

A teen driver was faced with charges after a fatal car crash in which an 18-year-old Framingham High School student died from the personal injuries he sustained.

Jamoan James died and two other students sustained personal injuries after their car struck a tree on Southville Road.

According to officials on December 18, another car was also involved in the crash and its driver, 18-year-old Framingham resident Ian Schimke, was arrested on December 17. Police charged him with motor vehicle homicide by negligent operation, leaving the scene after causing personal injury resulting in death, and operating a motor vehicle negligently to endanger. He pleaded not guilty and was ordered held on $25,000 bail.

Soon after what initially seemed to be a single-vehicle crash shortly before 11:30 p.m. on December 8, investigators began to develop evidence of a second vehicle that fled the scene. The resulting investigation led to Schimke’s arrest. Police believe him to be the driver of the vehicle that caused the crash.

According to police, on the night of the crash, Schimke was driving a 1998 Chevy Lumina and James was driving a 2003 Dodge Intrepid on the night of the crash. Officials say Schimke’s vehicle had pursued James’ vehicle from Ashland into Southborough.

While traveling west on Southville Road at speeds exceeding the posted limits, Schimke’s vehicle pulled behind James’ vehicle and intentionally struck the rear fender. Shortly afterwards, Schimke’s vehicle crossed into the eastbound lane, pulled along the left side of James’ car and intentionally struck the right rear quarter panel.

As a result of the impact, James lost control of his vehicle, which spun off the side of the road and crashed into a tree. Police say that immediately afterward, Schimke’s vehicle slowed down, drove by the scene, and then drove away.

Why Are Teens Not Wearing Their Seatbelts?

Seatbelt usage among Massachusetts teens has fallen below the state average, which is causing great concern. This year alone, teens’ compliance with seatbelts has dropped by 10 percent, despite the public awareness of the importance of seatbelts.

For some reason, teens have not been making the simple decision to buckle up while riding or driving on Massachusetts roads and highways. This effortless action of putting on a seatbelt can save lives and prevent serious injuries from car accidents. An article appeared in the Herald News describing one woman’s experience from a car crash as a teenager. Her vehicle was broadsided and unfortunately, she was not wearing her seatbelt at the time of the crash. As a result, she suffered severe injuries that left permanent side effects.

Proper use of seatbelts can prevent ejection from the car and can slow down the body during a collision to avoid smashing into the dashboard or windshield. There are laws in Massachusetts regarding the use of seatbelts. In Massachusetts, it is mandatory that the driver and passengers wear their seatbelts while the vehicle is in operation. Law enforcement has the authority to issue citations for anyone not wearing a seatbelt. The fine is $25 per person. Each person in the vehicle who is over the age of 16 and not wearing a seatbelt can be fined. If the passengers are under the age of 16 and not wearing seatbelts, the driver will be cited.

The major question regarding this issue is – how do you encourage teens to buckle up? Campaigns to raise awareness should continue, which show the importance of seatbelts. At the same time, parents, caregivers and teachers must do their part in encouraging teens to wear seatbelts by explaining the consequences of not being properly restrained during a car accident.

Mandatory Reporting of Child Abuse & the Department of Social Services

Childhood should be a carefree time of play, sports, learning and other activities. A child should not have to endure abuse or neglect from a day care provider, teacher, parent or other caregiver. Laws have been created in Massachusetts that protect children who are victims of abuse or neglect. Massachusetts Child Abuse Laws establish mandatory reporting of child abuse or neglect and define the role of the Department of Social Services.

Child abuse can be physical or emotional and also includes sexual abuse, neglect and malnutrition. It can be defined as the “non-accidental commission of any act, by a caretaker, upon a child under age 18, which causes or creates a substantial risk of physical or emotional injury, or constitutes a sexual offense under the laws of the Commonwealth, or any sexual contact between a caretaker and a child under the care of that individual.”

Based on the Massachusetts Child Abuse Laws, certain individuals are required to report suspected child abuse cases to the Department of Social Services. The list of individuals who are required to report child abuse is long and includes such people as physicians, teachers, ministers, medical examiners, counselors, day care workers, social workers, policemen and firefighters. The mandated reporter must notify the Massachusetts Department of Social Services immediately if he or she suspects that the child, who is under the age of eighteen, is the victim of physical or emotional abuse or neglect.

After receiving the notification from the mandated reporter, the Massachusetts Department of Social Services will begin an investigation into the child abuse allegation. If a child is in immediate danger, he or she will be taken into temporary custody. In some situations, the District Attorney will be contacted regarding the child abuse case. These circumstances include a child’s death, sexual assault, brain damage of the child, sexual exploitation of the child or other serious injuries sustained from the alleged abuse.

If you feel that your child has been the victim of abuse or neglect, you need to speak with a Massachusetts child abuse attorney right away. Contact Thomas M. Kiley & Associates, LLP at (978) 474-8670 or (800) 930-8145 for legal advice.

Man Dies After Being Hit by a Dump Truck

Two businesses cited for safety violations in connection to an incident in which 31-year-old construction worker Robert Augeri, of Londonderry, died of the personal injuries he sustained after being hit by a dump truck have reached settlement agreements with the Occupational Safety and Health Administration, according to OSHA spokesman John Chavez.

Brox Industries, of Dracut, and Lewis Maynard Trucking, of Methuen, have both reached an agreement to correct safety violations and have had fines against them reduced.

On June 3, Augeri was working on a highway paving project in Interstate 495's northbound lane in Lawrence when a Mack dump truck backed into him in the closed left travel lane.

Augeri was employed by Brox, the company the Massachusetts Highway Department contracted for the repaving job. The truck's driver, 25-year-old Methuen resident Robert McCann, was a subcontractor employed by Lewis Maynard Trucking. He and his passenger, 23-year-old Methuen resident Christina DeForte were uninjured.

On November 7, Lewis Maynard Trucking was cited by OSHA for a serious violation and issued a fine of $1,500 for failure to start and maintain an effective safety program, according to OSHA documents. The company was given until December 29 to pay the fine and fix the problem.

Chavez said that on December 3, the company agreed to correct the violation and the fine was reduced to $900.

On October 30, Brox was cited by OSHA for failure to ensure that its safety program dealt with directing traffic in areas where workers were on foot and for failure to ensure that employees were properly trained. The company agreed to correct the violations on November 24 and the original fine of $15,000 was reduced to $10,000.

Route 128 Accident Results in Personal Injuries

On Sunday, December 7, a motorist and a state trooper both sustained personal injuries in separate weather-related crashes as a coating of slick snow sent drivers skidding off the roadways.

According to Massachusetts State Police, at approximately 9 a.m., an unidentified woman lost control of her vehicle, causing her to careen into two state police cruisers parked in the break-down lane on Route 128 in Needham. The troopers had left their vehicles to assist another motorist and spotted the approaching vehicle before scrambling to safety.

The woman received transport to Beth Israel Deaconess Medical Center in Needham.

In Newton, a state trooper sustained personal injuries when his car crashed on northbound Route 128 shortly before 7:30 a.m. He received treatment at the Lahey Clinic in Burlington and was released.
First Snowfall Causes Several I-91 accidents

Early on the morning of Sunday, December 7, drivers were caught off guard by the first snowfall of the season, as several accidents were caused by cars sliding off the highway. Some required transport to area hospitals for personal injuries, but Massachusetts State Police Trooper Brian Pearl said that none of them were serious.

One driver slid into a police cruiser parked alongside Interstate 91 in Holyoke after a collision with another vehicle, but Pearl said the trooper was not in the vehicle because he was assisting with another crash.

Between 1 and 4 a.m. on Sunday, there were reports of more than a dozen accidents between Northampton and Holyoke. Pearl said the majority took place on I-91 in Holyoke near exits 15, 16, and 17. Nine accidents were also reported early Sunday by State Police in Springfield. Police also said that snow flurries returning around 3 p.m. caused a number of minor crashes in Franklin Berkshire Counties. Though most of the snow-related accidents took place on the highway, police throughout Western Massachusetts also reported a few minor accidents.

Deadly Accidents in Mendon and Windchendon

Two people died of the personal injuries they sustained in separate car crashes in Winchendon and Mendon on November 30.

Tracy Rumery, a 37-year-old West Springfield woman was the victim of the fatal crash in Winchendon. She died after her vehicle swerved into the southbound lane of Route 140 and collided with two oncoming vehicles shortly before 6:30 p.m. She received transport to Heywood Hospital in Gardner, where she was later pronounced dead.

According to police, Gardner resident Scott Cloutier was the driver of the first vehicle to hit Rumery. A passenger in his 2005 Ford Escape required hospital transport for injuries that seemed to be non-life-threatening.

Rumery's 1998 Chevrolet Monte Carlo then collided head-on with the 1995 Jeep Grand Cherokee of driver Joseph Ziroli of Johnston, Rhode Island. He and his passenger also received transport to the Gardner hospital with non-life-threatening injuries.

Also on November 30, a man from Uxbridge died in Mendon after his truck hit a tree and a rock before bursting into flames with him trapped inside shortly after 4 p.m. Fifty-four-year-old Peter Steeves received transport to Milford Regional Medical Center, where he later died.

Police say Steeves' 2003 Chevrolet Silverado was eastbound on Hopedale Street when it crossed the road and hit the pole and tree. According to initial calls to 911, Steeves was trapped within the truck and was unresponsive when a passer-by freed him. The passer-by cut his hand in the process and also received transport to the hospital.

According to Sgt. Brian Massey, the road was wet at the time of the crash and speed and alcohol may have been factors.

Dangerous toys continue to abound in toy boxes and on store shelves despite recent media attention and legislative action. An astounding number of defective toys are still reaching the marketplace as evidenced by the slew of recalls in the last year. In the nearly twelve month period since W.A.T.C.H.’s last “10 Worst Toys” conference, there have been at least sixty-six (66) toy recalls representing over seven million eight hundred ninety thousand (7,890,000) units of dangerous toys polluting the marketplace.
3.9 Million Verdict a Victory for Massachusetts Plaintiffs

This week's verdict which awarded $3.9 Million to a Boston woman, Rita Traybman, who lost her leg in an accident with an MBTA bus, is truly a victory for Massachusetts plaintiffs. Massachusetts juries often inadequately compensate injured people for life threatening and permanent injuries. My hope is that jurors are beginning to realize the value in serious personal injury cases. This verdict may seem like a lot of money to award someone who was injured in a personal injury accident, but no amount of money will give Ms. Traybman her leg back. She will also require life long medical care and appropriate living conditions for her injuries. We wish her the best of luck in the future.

For more information on this verdict, visit our news section of our website.

What Causes SUV Rollovers?

A sport utility vehicle, also known as an SUV, is three times as likely to be involved in a rollover as the average passenger vehicle. The highest rate of deaths resulting from rollover accidents are in SUVs.

Originally, the SUV was created for off-road driving and was not designed as a family car, which it is commonly known as today. Since the target market for SUVs has changed, manufacturers have stopped installing the roll bars that protect the occupants in the vehicle in case of a rollover crash. Now when an SUV rolls over, it often results in devastating injuries and sometimes death.

There are many theories as to why SUVs rollover more easily than other vehicles. The size and height of the vehicle plays a significant role in the rollover risk. Speeding has been a major factor in many rollover accidents. Studies have shown that almost two-thirds of rollover accidents occur in a driving zone where the speed limit is 55 miles per hour or higher.

Driver distraction and inattention is also believed to be a cause of rollover accidents. Numerous rollovers take place after a driver steers hard to avoid a foreseeable danger. The SUV frequently loses control when a driver overcompensates, which initiates the rollover. Once the SUV is off the pavement, a ditch, soft soil or other factor can contribute to the rollover accident.

Some SUV rollovers are due to manufacturing defects. A few years ago, Toyota Motor Corp. recalled 880,000 SUVs and pickup trucks after it detected a serious defect that could impact steering. Other vehicles, such as the Ford Explorer, Isuzu Rodeo and Honda Passport have also been involved in rollover accidents that resulted in serious injuries and death.

If you have been injured in a rollover accident, contact the Massachusetts car accident attorneys at Thomas M. Kiley & Associates at (800) 930-8145. We can help you determine the cause of your rollover accident and if any legal action should be taken.

Causes and Treatment of Hypoxic Ischemic Encephalopathy among Infants

Hypoxic ischemic encephalopathy is a serious injury that affects thousands of infants in the United States every year. It is an injury that damages the cells in the central nervous system and can lead to a more permanent condition.

Doctors and hospitals sometimes make mistakes that can greatly impact an expecting mother and unborn child. These errors can cause birth injuries, which result in developmental delay, mental retardation and cerebral palsy. Specifically, hypoxic ischemic encephalopathy occurs when the brain is deprived of the necessary oxygen. Lack of oxygen to the brain can cause substantial damage to the delicate brain tissue.

There are many things that can go wrong during the labor and delivery process. When a C-section is delayed, the baby remains in the birth canal too long, the fetal heartbeat is misread or the doctor and hospital staff do not act in a timely manner, it can result in hypoxic ischemic encephalopathy. This type of injury is usually identified immediately following birth, as there may be various symptoms including, coma, loss of brainstem signs, loss of deep tendon reflexes or seizures.

The treatment for hypoxic ischemic encephalopathy depends on the damage to the brain. Some of the treatments for hypoxic ischemic encephalopathy include life-sustaining treatment, mechanical ventilation, control of blood pressure, maintenance of the heart function, medication or general anesthesia to control seizures and cooling blankets to reduce the body temperature.

Many times, hypoxic ischemic encephalopathy could have been prevented. If your baby was injured during birth, contact an experienced Massachusetts birth injury attorney for legal advice. Doctors and hospitals can be held liable for serious birth injuries, such as hypoxic ischemic encephalopathy. Call Thomas M. Kiley & Associates at (800) 930-8145 for a free consultation regarding your case.

Erb?s Palsy Symptoms & Treatment

Mistakes made during the labor and delivery process can cause serious injuries to newborns. Each year, thousands of birth injuries occur across the United States. While some injuries are very difficult to prevent, others can be avoided. Erb’s palsy, also known as Brachial palsy, Klumpke paralysis and Erb-Duchenne paralysis, is a birth injury that is usually caused by an injury that occurs during birth. It is a condition that is often preventable, as long as the hospital and doctors take the appropriate measures.

Erb’s palsy is defined as a loss of movement or weakness of the arm, which is the result of damage to the nerves around the shoulder. This condition can have many causes, such as prolonged labor, breech position, induced labor and the fetal position. If the baby is pulled on the shoulders during the birthing process, such as in a situation where the doctor pulls the infant as he or she passes through the birth canal, the risk of developing Erb’s palsy increases.

Symptoms of Erb’s palsy are usually identifiable immediately or soon after birth. Erb’s palsy can cause partial or complete paralysis. Some of the symptoms include an absence of the startle reflex, a flexed arm at the elbow that is held against the body, decreased grip and lack of spontaneous movement in the upper or lower arm or hand. If the injuries are severe, the newborn may even have a droopy eyelid.

Erb’s palsy can be diagnosed by a pediatrician’s evaluation or through tests, including x-rays, CT scans and MRI scans. A mild injury will eventually correct itself, usually after several months. If the infant does not improve, surgery may be required. Other treatment options include tendon transfers, nerve transfers and subscapularis releases. If your child has been diagnosed with Erb’s palsy, you should discuss the various treatment methods available with your child’s physician.

If your newborn was injured during the birthing process as a direct result of the hospital or doctor’s negligence, you should contact a birth injury attorney who can help you file a claim. Contact Thomas M.
Symptoms of Shaken Baby Syndrome (SBS)

Shaken Baby Syndrome is a serious condition that can lead to permanent disabilities and even death. It is also a preventable condition. Massachusetts has taken major steps in helping to educate the public regarding Shaken Baby Syndrome and in 2006, a bill was signed to prevent it.

The bill is titled, Chapter 365 of the Act of 2006 and it took effect immediately. The law implemented a statewide Shaken Baby Syndrome prevention initiative to educate and train parents, caregivers and professionals. It also provides support to victims of Shaken Baby Syndrome.

While most people have heard of Shaken Baby Syndrome, the exact physical causes are not widely known. When someone shakes an infant or young child, the child’s head whips back and forth, consequently slamming the fragile brain tissue against the hard skull. As a result of this force, bruising, bleeding and swelling of the brain can occur. Children younger than 2 years of age have weak neck muscles, which makes them more susceptible to Shaken Baby Syndrome.

If you have a young child, you need to be aware of the symptoms of Shaken Baby Syndrome. The earlier the condition is detected, the better the chances of your child’s survival. Warning signs of Shaken Baby Syndrome include:

• Changes in behavior, including extreme irritability
• Appears lethargic, sleepy and not smiling
• Lack of appetite
• Alertness is decreased
• Loss of consciousness
• Skin looks pale or bluish
• Vomiting
• Convulsions or seizures
• Not breathing

Any of these symptoms should prompt you to take your child to the emergency room immediately. Serious injuries often follow Shaken Baby Syndrome, including developmental delays, brain damage, blindness, spinal cord injury, mental retardation and impaired use of arms and legs.

Kids Transportation Safety Act Helps Make Vehicles Safer

Cameron Gulbransen was tragically killed one evening five years ago when his father accidentally backed over him in his Sport Utility Vehicle. The SUV that the Gulbransens thought was a safe family vehicle had a rear blind zone so long, that Gulbransen could not see his small son, who had slipped outside the house and into the driveway undetected.

It is estimated that 50 kids are being backed over on a weekly basis, with as many as 2 deaths for every accident. These accident related deaths are needless tragedies.

The Cameron Gulbransen's Kids Transportation Safety Act became law in February of 2008. This law allows the U.S. Department of Transportation to issue standards including provisions for a rear visibility standard, precautions, and the evaluation of power window sensors.

Parents in the Gulbransen's position may experience terrible guilt surrounding these accidents. However, automobile manufactuers share responsiblity in product defects. There is potential for personal injury, product liability, and wrongful death claims in situations such as these.

This legislation will help make vehicles safer for all of us including our kids.

For more information please visit http://www.dot.gov/

Defective Toys and Products that Cause Injuries in Massachusetts

There are numerous children’s toys and products recalled every week in the United States. Reasons for these recalls range from harmful lead exposure to strangulation hazards. Too many children are hurt each year by products that should be considered safe. We put our trust in manufacturers, believing that the toys we let our children play with are free of dangers.

There have been many stories in the news recently of young children being injured by cribs and bassinets. These young children were hurt because of a design flaw in the product, which ultimately led to massive recalls in an attempt to avoid any further child injuries.

Unfortunately, children are hurt by toys and products that may or may not have been recalled. When a child is injured by a toy, crib, bassinet or other product, the manufacturer, distributor, retailer, importer or other party involved in the distribution of the product can be held liable. These types of cases are called product liability lawsuits. A product liability lawsuit can include a situation where the children’s product was defectively designed, flaws existed in the manufacturing process or there was a failure to warn consumers of a known hazard.

Product liability cases are difficult to win, as the manufacturer or other responsible party will employ their resources to make sure you are not successful. They know that if you win your case, more lawsuits from other consumers may follow. Their defense team will work hard to show that the product was not defective. However, an experienced Massachusetts defective product attorney, such as Thomas M. Kiley, can gather the necessary evidence and facts to help you win your case. Contact Thomas M. Kiley & Associates at (800) 930-8145 if your child has been injured by a toy or other product.

Massachusetts State Minimum Car Insurance Often Provides Inadequate Coverage

At Thomas M. Kiley and Associates, we represent clients who have been seriously injured. All too often we run into the scenario that there is not enough insurance coverage to adequately compensate them. The Massachusetts compulsory coverage for bodily injury is $20,000 per person with a maximum of $40,000 per accident. What this means is that if a person is hurt in a car or pedestrian accident and the person responsible only carries the state minimum coverage, the most any one person can collect is $20,000 and the most the insurance company will pay for any one accident is $40,000, regardless of how severe the injuries are.

Drivers do not realize how inexpensive increased coverage can be and are often think they are fully protected because they have "full coverage". This is not always the case. I always recommend that people purchase the most coverage that they can afford. You can help protect yourself by purchasing underinsured/ uninsured coverage. Contact your insurance representative for more information. You can also visit our library for a break down of the different types of car insurance coverage available in Massachusetts or www.mass.gov/DOI for more information.

Train Crash is a Reminder of the Dangers of Text Messaging

The recent deadly Chatsworth, California train crash reminds us of the dangers of text messaging. It remains unknown if the train operator was texting at the time of the crash but it is known that he had been sending and receiving texts while on the job that day. It is estimated that this crash will bring about millions if not billions of dollars in law suits for the wrongful deaths and personal injuries of passengers. This is a message to all of us that we should be using hands free devices while talking on a mobile phone and should not be texting while driving. Currently Massachusetts does not have a hands free law, but we should expect one in the future.

Thomas M. Kiley & Associates represented a young woman whose convertible was run over by an SUV as it crossed into her lane of travel. The driver of the SUV was operating her vehicle negligently while talking on her cell phone. Our client suffered very serious and life threatening injuries including a head injury, facial fractures, a pelvis fracture and extensive muscle and tissue damage. If you have been hurt in an accident as the result of a distracted driver, contact us today.

Defective Automobiles In Massachusetts

There are very few things as frustrating as dealing with a new automobile that constantly needs repairs. If it seems as though your car is in the repair shop more often than not, your vehicle may be considered a lemon. Under federal and state Lemon Laws, a consumer can be eligible for a refund, replacement or cash compensation for a defective automobile.

Consumers often ask the question, “How do I know if the car is a lemon?” The Massachusetts Lemon Law defines a lemon as “a new or leased motor vehicle that has a defect which substantially impairs the use, market value, or safety of the vehicle, and which has not been repaired after a reasonable number of attempts.” New cars, motorcycles, vans and trucks are all covered by this law. There are certain requirements that must be met before a vehicle is considered a lemon. For example, the vehicle must be purchased from an auto dealership in Massachusetts for the purposes of personal or family use. The law provides protection for one year from the purchase date or 15,000 miles of use from the original delivery date, whichever comes first.

Reasonable attempts at repair for the defect must be made before compensation is given. If the vehicle cannot be repaired, the manufacturer should offer to replace it or refund the consumer’s money. Even though the law requires that manufacturers take this action, they are not always cooperative. Sometimes you need the help of an experienced attorney who can help you recover compensation under the Massachusetts Lemon Law or applicable federal laws. Contact Thomas M.
