  • Delaying labor can decrease risk of cerebral palsy
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal issues surrounding cerebral palsy and birth injuries. The New England Journal of Medicine, http://www.nejm.org, published a report that says preterm infants born to mothers receiving intravenous magnesium sulfate — a common treatment to delay labor — are less likely to develop cerebral palsy than are preterm infants whose mothers do not receive it. The research was done by the National Institute of Health research network,http://www.ninds.nih.gov/news_and_events.

The research showed that a third of all cases of cerebral palsy are associated with preterm birth and that of those cases, there was a significant reduction in cerebral palsy among preterm infants whose mothers were given magnesium sulfate. The researchers theorized that magnesium sulfate protects against cerebral palsy because it can stabilize blood vessels, protect against damage from oxygen depletion, and protects against injury from swelling and inflammation.

  • FDA Needs Authority Over Diet Supplements
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal issues regarding defective products. Over half of all Americans use some kind of dietary supplements such as vitamin pills, diet pills, herbs, and energy drinks, according to a recent article in the New York Times,
http://www.nytimes.com/2009/03/04/business/04diet.html?_r=1. The numbers are huge—Americans spent close to $25 billion on dietary supplements last year, according to the Nutrition Business Journal. But a new study shows that the Federal Food and Drug Administration, (FDA), http://www.fda.gov, cannot guarantee these products are safe because it does not have enough authority to oversee their production.

This is becoming a bigger problem with more and more supplements being produced in other countries without the same safety standards as in the US. And some of those products are proving to be unsafe. In 2008, the FDA received 948 reports of health problems related to dietary supplements; of those there were 9 deaths, 64 life-threatening illnesses, and 234 people admitted to the hospital. The report by the Government Accountability Office (GAO) says those numbers don't include everyone—the problems are underreported. The GAO report suggests that Congress give the FDA the authority they need to oversee these dietary supplements that don't currently have approval by the FDA.
  • Private food auditors inspecting food plants
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal issues regarding defective products. According to a recent article in the New York Times, government officials are overwhelmed with inspecting the nation's food supply and are turning to private auditors to do the job.

    The article, http://www.nytimes.com/2009/03/06/business/06food.html?_r=1&hp
documents that it was a private auditor who missed the salmonella contamination at the Peanut Corporation of America plant in southwest Georgia. Although the inspector gave the plant a superior rating, the plant shipped out contaminated peanut products for nine months, and those products sickened 22,500 people and killed nine.
  • Is organic food safe to eat?
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal issues surrounding defective products. A recent New York Times article examines the national outbreak of salmonella in peanut products and the fact that although the plants in Texas and Georgia that sent out contaminated products had federal organic certification their products made people sick. Now people who use organic produce because they want their families to be healthier are concerned about this organic certification.

    The article, http://www.nytimes.com/2009/03/04/dining/04cert.html?scp=1&sq=&st=nyt
says that although the rules governing organic food require health inspections and pest-management plans, organic certification technically has nothing to do with food safety. Urvashi Rangan, a senior scientist and policy analyst with Consumers Union, the nonprofit publisher of Consumer Reports, said people should not assume that organic foods are safer in terms of pathogens.
  • Firm fakes generic drug tests
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkiley.com, concentrates on legal issues regarding defective products. A recent article in the Washington Post indicates that the Federal Food and Drug Administration (FDA) http://www.fda.gov, announced that India's largest drugmaker has falsified laboratory tests for generic drugs that were approved for sale in the US.

    According to the article, http://www.washingtonpost.com/wp-dyn/content/article/2009/02/25/AR2009022503715.html?hpid%3Dmoreheadlines&sub=AR
the FDA identified problems at the Ranbaxy Laboratories plant in Paonta Sahib where evidence shows they falsified data and test results in approved and pending drug applications for 25 drugs that were approved by the FDA. They don't believe any of those medications are on the shelves of any US pharmacies because Ranbaxy has been prevented from exporting more than two dozen drugs in the US.
  • Thrift stores comply with new lead law
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal issues regarding defective products. In recent years, many products being produced overseas without safety standards overseen by the Federal Food and Drug Administration have been found to be contaminated by lead and are unsafe. This had led to many recalls and also a new law enacted by Congress to deal with this problem. A recent article in the Boston Globe indicates that this new law is causing compliance problems for thrift stores and second-hand stores,
    http://www.boston.com/business/articles/2009/02/27/lead_puts_thrift_stores_in_lurch.

According to the article, stores such as Goodwill have had to stop selling children's clothing, which is cutting off an important source of cheap clothing for families struggling with the recession. The Consumer Product Safety Improvement Act, which took effect Feb. 10, prohibits all shops from selling children's products that contain too much lead or potentially harmful chemicals. Congress passed the law in response to a series of recalls of toys and jewelry that had high lead content and were linked to several child deaths and illnesses. The Consumer Product Safety Commission http://www.cpsc.gov, said the law was implemented because of concern about lead contamination in metal zippers and snaps, screen printing, rhinestones, and other embellishments on clothing, as well as in children's toys and jewelry and furniture.
  • FDA warns about psoriasis drug andoverma
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal cases regarding defective products. A recent Boston Globe article announced that the Food and Drug Administration and European Medicines Agency warned consumers that a drug psoriasis medicine called Raptiva was linked to four cases of a deadly brain infection, http://www/boston.com/business/healthcare/articles/2009/02/20/sales_of_psoriasis_drug_may_be_halted.

According to the article, there have been three confirmed cases and one possible case of progressive multifocal leukoencephalopahy in patients taking Raptiva; three of those patients died.

The FDA, http://www.fda.gov, issued a public health advisory concerning Raptiva because of the connection to the rare brain infection. PML is caused by a virus that affects the central nervous system. PML usually occurs in people whose immune systems have been severely weakened. It leads to an irreversible decline in neurologic function and death. Symptoms may include unusual weakness, loss of coordination, changes in vision, difficulty speaking and personality changes. There is no known effective prevention or treatment.
  • FDA warns of diet pills andoverma
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on defective product liability law. He wants consumers to know about new evidence from the Federal Drug Administration, http://www.fda.gov, that says weight loss capsules called StarCaps, promoted as a natural dietary supplement, could be a health hazard.

According to an article in The Boston Globe, http://www.boston.com/business/healthcare/articles/2009/02/10/fda_finds_more_hazardous_diet_pills, the FDA found the capsules contain a drug called bumetanide which can have serious side effects. The FDA has found that dozens of weight-loss supplements, most of them imported from China, contain potentially harmful drugs, that has resulted in consumer warnings and recalls from some distributors. The FDA calls a drug illegal if a weight-loss supplement contains an undeclared active pharmaceutical that can cause problems like elevating blood pressure or seizures, or could have toxic interactions with other medications and make it hard for doctors to diagnose the problem.

Another dietary supplement has come under investigation from the FDA. Venom Hyperdrive 3.0 contains sibutramine, a controlled substance with risks for abuse or addiction, and the FDA says it is a potent drug that poses safety risks for consumers.
  • Judges ruling affects vaccine controversy andoverma
Description: In an article in the New York Times, http://www.nytimes.com/2009/02/13/health/13vaccines.html?_r=1, three federal judges ruled against three families in test cases seeking compensation from the federal vaccine injury fund. The judges said that the families had not shown that their children's autism was brought on by the presence of thimerosal, a mercury vaccine preservative, by the measles virus used in the measles/mumps/rubella vaccine, or by a combination of the two. Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on legal cases regarding defective products.

According to the article, there are 5,000 more cases pending where families are seeking compensation from the Vaccine Injury Compensation Fund, administered by the Department of Health and Human Services. by trying to prove that vaccines injured their children. In a published statement, the department of Health and Human Services said this determination by federal judges should reassure parents that vaccines do not cause autism. The full reports of the Special Masters are available at

  • Beware of purchasing online prescription drugs andoverma-cfm
Description: A recent article points out the dangers of purchasing prescription drugs over the internet. As a Massachusetts attorney concentrating in personal injury law in Boston, Thomas M. Kiley, http://www.tomkileylaw.com, wants people to be aware of the legal issues when purchasing drugs online.

In a news broadcast on MSNBC, http://www.msn.com/id/28983195, a federal judge sentenced Jared Wheat, CEO of Hi-Tech Pharmaceuticals, to 50 months in prison for illegally selling knockoff prescription drugs over the internet. U.S. District Judge Jack T. • Imported drugs raise safety concerns for FDA andoverma
Description: As the public becomes more aware of imported products from countries which have less strict safety standards than the U.S., as indicated by the millions of recalled toys from China in the past year, the Federal Drug Administration wants consumers to beware of imported drugs as well. As a Massachusetts attorney concentrating on defective products liability cases, Thomas M. Kiley, http://www.tomkileylaw.com, wants consumers to be aware of possible safety concerns from imported drugs.

The exact amount of imported drugs that come into the United States is hard to track, and the high volume makes it impossible to examine them all. The FDA's Office of Criminal Investigations, http://www.fda.gov, is working to uncover major black market pharmacy rings selling illegal pharmaceuticals.
  • Contaminated peanut products affecting food banks and schools andoverma
Description: Massachusetts attorney Thomas M. Kiley, http://wwww.tomkileylaw.com, concentrates in product liability law. The most talked about recall products right now are the peanut products produced by Peanut Corporation of America that are causing people to become sick from salmonella bacteria. The contaminated products are affecting not only the general public, but also food banks and schools.

A recent article in the New York Times,
    http://www.nytimes.com/2009/02/07/business/07peanut.html?_r=1&hp,
says that school lunch programs in California, Idaho, and Minnesota received peanut products that could have been tainted. The products they received were not on the first list of recalled products, but the recall list has since expanded.

In an article by Beverly Beckham in the Boston Globe, http://www.boston.com/news/local/articles/2008/11/30/father-does-his-part-for-child-safety, George DeCell, a stay-at-home dad from Fairfax, VA, described the accident when his daughter accidentally choked on the plastic outlet cover five years ago. The cap was like a stopper in a drain, blocking her airway. Once she stopped struggling, he was able to remove it. On that day, he swore he would change the design of the outlet cap so that other children would not choke.

DeCell wrote to the US Consumer Product Safety Commission (CPSC), http://www.cpsc.gov, explaining what had happened and urging the board to issue a standard for electrical outlet safety plugs similar to the ones that regulate pacifiers. Pacifiers used to choke kids, until a federal law changed the way they were made adding holes so air could get through if a child choked on it. The CPSC board rejected his request.
  • Consumer safety groups look for help defective product andover ma
Description: Consumer safety groups have been concerned about the lower labor costs associated with manufacturing products overseas which sometimes results in poor quality that puts consumer safety at risk from defective product injuries. Often these injuries occur to children—accidental injury is the leading cause of injury and death to children under age 14. Consumer groups are hoping that a new presidential administration might be persuaded to change these statistics. Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on defective product liability cases in Boston.

A recent article published by Public Citizen, a consumer safety group http://www.citizen/org/pressroom/release, says the Consumer Products Safety Commission details huge numbers of recalls of products with violations of lead paint standards (all imported from offshore countries), or appliances that catch fire. The latest recall, according to the article, involves an expansion of an additional 131,000 of a previous recall of infant rattles that could cause a choking hazard. Since the original recall, there have been 10 additional reports of choking from the tail pieces from the Infant Lion and Lamb Grabby rattles, according to the website.

Public Citizen sent a letter to the Obama Transition Team upon President Obama's inauguration deploring "the abusive practice of inserting language in the preambles of, or in federal regulations for the purpose of immunizing manufacturers from liability for injuries caused by faulty products.” Public Citizen is urging President Obama to require that manufacturers provide reliable and safe products for the consumer. They want to see changes to the current legislation that protects businesses giving them immunity from liability.

According to a Safe Kids Worldwide Toy Safety Fact Sheet, http://www.usa.safekids.org, in the United States, more than 3 billion toys and games are sold annually. Where can parents find information on recalls of toys and child products? • Parents beware of lead tainted toys defective products Andover MA
Description: Massachusetts attorney Thomas M. Kiley, http://www.tomkileylaw.com, concentrates on defective product liability cases and is concerned about the large numbers of lead tainted toys imported from other countries which have less strict safety standards than the US. Last year, over 45 million toys and children's products – 30 million from China – were recalled, according to an article in the Seattle PI Newsource, http://www.seattlepi.newsource.com. In fact, China currently makes 80% of the toys in the U.S. Over 140 of the 152 consumer product recalls for unsafe lead materials issued in the past six years have been products manufactured in China. There are currently 400,000 children suffering from lead poisoning in the U.S. These startling numbers prompted both the House and Senate to pass legislation imposing the toughest lead standards in the world, banning lead beyond minute levels in products for children 12 or younger. This legislation takes effect February 10, 2009, It also bans children's products – either permanently or pending further study – containing six types of phthalates, chemicals found in plastics and suspected of posing health risks. For more information on this new legislation, go to http://www.cpsc.gov.
