A serious amusement park accident such as a head injury or brain injury can devastate and completely change your child’s life. If your child has been injured at a theme park in Massachusetts you should contact an experienced Massachusetts child injury lawyer to determine liability.
Since amusement parks are not federally regulated, many child injuries go unreported. For that reason, the number of child injuries is likely much higher than we can accurately gauge by only looking at reported statistics.
Who Regulates Amusement Parks in Massachusetts?
In Massachusetts, the state government regulates amusement parks.
Government officials from the Massachusetts Department of Public Safety are tasked with investigating any amusement park injuries or theme park fatalities. Massachusetts law spells out the requirements for operators of amusement parks within the state.
Preventing Future Amusement Park Injuries
Ed Markey, a Democratic congressman from Massachusetts, has tried for many years to increase federal oversight of amusement parks. After a number of high-profile child injuries, Congressman Markey believes that the CPSC should have jurisdiction over fixed amusement parks in addition to their oversight of traveling theme parks and carnivals.
In 2007, Congressman Markey introduced the National Amusement Park Ride Safety Act, but the bill never made it out of congressional committee.
To prevent more child injuries from occurring in amusement park accidents, Markey believes it’s imperative that the CPSC (or some other federal organization) be given oversight of amusement parks on a national level. Federal safety standards should be implemented for all amusement parks, including carnival rides and traveling theme parks.
If your child has suffered injuries at an amusement park, you may be able to seek compensation for your child’s injuries from the negligent party.
