Fireworks in Massachusetts – Learn Your Rights from a Lawyer (Part A)

Should consumer use fireworks be allowed in Massachusetts?

It’s a topic of conversation every year. Currently Massachusetts fireworks laws prohibit personal use.

Legalizing Fireworks in Maine

In nearby Maine, lawmakers are considering legalizing the sale of fireworks.

Some of the points made by Maine legislators include:

  • The sale would generate significant revenue for Maine.
  • By licensing the sale, greater safety would be ensured for consumers.
  • Many citizens disregard the law already and buy fireworks in neighboring states.
  • They believe the banning of fireworks is illogical given that other dangerous items are not similarly banned, i.e. chainsaws, blow torches, etc.

A firework accident can ruin and completely change your life. If you have been injured at a playground, carnival, Disney World, or amusement park in Boston or Andover you should contact an attorney to learn about your rights and determine liability. Massachusetts has a statute of limitations that may prohibit you from filing a law suit. Contact the Kiley Law Group for guidance on your personal injury case.

Other States Weigh in on the Debate

  • Arizona is also considering legalizing the sale of consumer-grade fireworks. Their bill would give permission to the fire marshal to regulate the sale of fireworks. Firefighters are speaking out against the bill.
  • Michigan has been diligently working on legalizing the sale of certain fireworks in the state for the past couple years. Currently, toy noise makers, sparklers, toy snakes, toy smoke devices, and cone/cylinder fountains are legal. Michigan is looking to cash in on new tax revenue for the state that it loses each year to neighboring Ohio and Indiana.
  • New York has legislation introduced as well to legalize the “safe and sane” fireworks. The reasoning is much the same as other states. Consumers already buy the fireworks in neighboring states, Connecticut and Pennsylvania. By legalizing and controlling the sale, New York could capitalize on the revenue previously provided to the other states.

Massachusetts Fireworks Debate

Even if Maine, Arizona, Michigan, or New York were to legalize the sale, does that mean Massachusetts should legalize the sale of consumer fireworks?

At least some citizens think so. They have created online petitions at PetitionSpot.com and GoPetition.com seeking support for their efforts to legalize the sale of consumer fireworks in Massachusetts.
