Liability Issues Following Child Deaths at Summer Camps
No parent expects their child's summer camp trip to turn into a fatal event resulting in the child's death. Yet, each summer many parents across the United States are faced with tragic news involving their loved one's traumatic injury or death while at camp.
This month alone there have been at least two cases of child deaths at a summer camp in Massachusetts, both events occurring within days of each other.
Recent Child Deaths at Summer Camps
- A 7-year-old boy died after a swimming pool accident at a summer camp in Shrewsbury, Massachusetts. The boy was found unconscious on July 14, 2011 in the outdoor pool at St. John’s High School, where he was participating in Camp Saint John, which is a day program for children ages 5-12. The boy was taking part in an “open swim” with about 40 other children. He died a week later.
- A 10-year-old Boy Scout from New York died in his sleep at a Rhode Island camp (Camp Yawgoog) on July 16, 2011. The boy was camping with his scouting troop when he was found dead in the morning.
- A 12-year-old boy collapsed and died on July 18, 2011 at a soccer camp at Wachusett Regional High School in Holden, Massachusetts.
While most child accidents are just that – accidents, in some cases the negligent actions of the camp staff may have contributed to the tragic outcomes of accidents resulting in child deaths.
Liability Issues
If the camp failed to provide adequately trained staff, your child's life-altering injury or death may have been the result of negligent CPR and first aid care. In the case of summer camp pools, the camp may also be held liable if it violated Massachusetts regulations for public aquatic facilities such as safety equipment requirements.
