Massachusetts Daycare Regulations and Child Daycare Abuse

There are strict regulations and guidelines that govern daycares and different types of childcare services around Massachusetts.

Childcare services in the state vary from in-home care, to child development centers, to day camps during the summer months and there are distinct guidelines for each of these providers to follow by law.

Regulations of Daycare Centers

Daycare regulations consist of managing the day-to-day operations at the center and issues regarding its personnel requirements, facility maintenance, activities, licensing, nutrition policies, and reports on each child's progress with the center.

In January of 2010, daycares around the Commonwealth were required to increase their documentation on how each child was progressing while in their care.

The changes to the daycare policies last year were aimed at reducing incidents of child injury, neglect and abuse in daycare centers.

However, if a daycare is negligent in practice and fails to adhere to the guidelines under the law due to inexperienced management, for example, additional reporting may not be able to save a child from suffering injuries while at the daycare.

A child may be injured while on the grounds of the daycare center in the following instances:

  • Failure of daycare staff to adequately supervise the child
  • Sexual abuse by daycare staff
  • Failure of daycare staff to identify symptoms of poisoning (i.e., if a child accidentally swallowed a harmful chemical negligently left out by staff)
  • Failure to identify the presence of lead paint or additional toxins on the grounds of the center
