Recovering from Your Personal Injuries

It is important that you keep appointments with your doctors and physical therapists and document your visits. From time to time, we will contact you to check on your treatment status. If you finish your accident related medical treatment before a personal injury lawsuit is filed, or a settlement is negotiated, let your attorney know so that he or she can accurately describe your injuries and recovery to the opposing parties.
Litigation and Out of Court Settlements
The vast majority of personal injury lawsuits in this country are settled out of court.
This can be beneficial to the plaintiff who may want a quick resolution to a case and need compensation to pay for medical bills and lost wages. Other clients may be intent on sending a message to insurance companies or the defendant and refuse to settle their case out of court.
Once we analyze your personal injury case and gather evidence to support your claim, we will build a comprehensive demand package detailing the theory of liability, details pertinent to the accident, your medical treatment and other associated expenses. The demand package is then sent to the insurance company for review.
When the insurance company receives the demand, the negotiation process begins. At this point, your personal injury attorney will most likely attempt to settle the matter with the claims adjustor – the person who typically makes an offer on the case.
If you wish to accept the offer, the settlement process begins. However, if you are not satisfied with the insurance company or opposing party’s offer, you have two choices:
- Present a counteroffer, or
- Proceed to litigation and file a lawsuit against the defendant who caused your accident.
Pursuing a Personal Injury Lawsuit
If you decide to pursue a personal injury lawsuit against the defendant, you may still receive an out of court settlement up until the point that the judge or jury returns a verdict on your case.
