Social Security Disability Lawyer Helping Disabled Victims in Massachusetts

At Kiley Law Group, we strive to provide the best possible legal help to disabled victims who have been denied Social Security Disability or Long Term Disability benefits.

Our Boston injury attorneys specialize in Long-Term Disability and Social Security Law in Massachusetts.

We believe you should not face financial ruin because you have been denied SSDI or LTD benefits. We are here to help you navigate the increasingly complex and frustrating claims process for Long Term Disability insurance, ERISA Disability Insurance claims, and Massachusetts State Pension Disability claims and obtain your rightful compensation.

Social Security Disability Benefits

The Social Security and Supplemental Security Income (SSI) disability programs are some of the largest Federal programs that provide financial assistance to people with disabilities.

Both programs are administered by the Social Security Administration (SSA) and meant to serve as safety nets for Americans.

We think of Social Security benefits as payments we will receive once we get old, and while this is correct, Social Security payments are meant to be there for people who have been injured in an accident and find themselves unable to work.

According to the SSA, in Massachusetts alone, over 1.27 million people received more than $1,265,988,000 each month in Social Security Disability and/or Supplemental Security Income benefits.

Social Security Disability Insurance

Social Security Disability Insurance (SSDI) pays benefits to people with disabilities and certain members of their family if they are insured. "Insured" means that you worked long enough and paid Social Security taxes.

Social Security pays only for total disability, not for partial or short-term disability.

“Disability” under Social Security is defined as the inability to work. The rules for disability under Social Security include:

  • You cannot do work that you did before;
  • You cannot adjust to other work because of your medical condition; and
  • Your disability has lasted or is expected to last for at least one year or to result in death.

Supplemental Security Income

Supplemental Security Income (SSI) is a Federal program funded by general tax revenues, not Social Security taxes.

It pays benefits based on financial need to aged, blind and disabled people who have little or no income to support themselves.

To receive SSI benefits, you must prove that you are:

  • 65 years or older,
  • blind, or
  • disabled

You may also need to prove that you:

  • have limited income and resources
  • are a U.S. citizen, national, legal alien
  • not absent from the country for more than 30 consecutive days
  • meet other SSI requirements.

Long-Term Disability Benefits

Long Term Disability (LTD) is an income replacement program that protects employees and their families in the event of a disability. It was designed to protect people who have become suddenly ill, have been injured in an accident, or have a weekend sports injury and are unable to work.

Workers Compensation Benefits

Workers injured on the job should be paid Workers' Compensation benefits and be provided with a timely medical treatment.

This is especially important for our First Responders, such as firefighters, police officers, paramedics, EMT, and correctional officers who put their lives on the line every day.

When Workers' Compensation benefits are denied, discontinued, or reduced, it might be necessary to hire a Massachusetts Workers Comp attorney.

Massachusetts workers are entitled to:

  • unpaid wages,
  • unpaid overtime, and
  • unpaid commissions their employers fail to pay.

They need the assistance of a Massachusetts Wage and Hour lawyer to get the wages they are rightfully due.
