Our eighteen-year-old client was driving on an interstate into
the early morning sun. As he drove over a rise in the road,
he struck a car that was disabled and stopped in the middle
of the road because a 150-pound wheel and tire detached from
a tractor-trailer rig traveling in the opposite direction.
The lugs holding the tire had broken off, causing the tire
and wheel to travel across the median strip, and hit and
disable the stopped vehicle.
Awarded: $ 3.5 million

A bus owned by Dufour Inc., veered off the road and into a ditch after the driver had a heart attack.
The driver, 69-year-old James A. Witherell of Williamstown, was pronounced dead at Berkshire Medical Center, according to police. Preliminary reports show that Witherell probably had a heart attack.
Witherell was driving a newer bus, known as the Berkshire Eagle, when the accident occurred. Five members of the Massachusetts College of Liberal Art’s program were injured after the bus crashed into the guard rails near Unistress. Pittsfield Police, Lanesborough Police, fire rescue from both communities and Lanesborough and County ambulances responded to the scene.
At the time of the Massachusetts bus accident, only 15 passengers were onboard. The bus was heading northbound on Route 8 at approximately 12:40 AM when it went off the road and into a gully. The bus was one of three that were transporting 80 members of MCLA’s Leadership Academy program home to North Adams from a night at Tanglewood in Lenox.
Witherell had worked for Dufour for 18 months. He had previously worked as a trucker and in security for GE in 1993.
The bus crash is being investigated by the Pittsfield Police Department.
