Texting While Driving Ban in Massachusetts
In July 2010, Massachusetts became the 29th state to ban texting while driving. Studies have shown that sending text messages while driving increases the risk of an auto accident by 23% and even hands-free conversations on a cell phone have been found to be just as dangerous from behind the wheel. Unfortunately, the number of distracted driving crashes continues to increase, with more than 800,000 drivers using a cell phone while driving at any moment in the United States.
Massachusetts Safe Driving Law
The Massachusetts Safe Driving Law became effective in September 2010, banning drivers from using mobile phones or mobile electronic devices while operating a vehicle. Penalties for violating the Safe Driving Law include:
- It is a violation punishable by up to a one-year driver’s license suspension and/or $500 fine for any junior to use any electronic device capable of providing data communication between two or more persons.
- Use of a mobile phone by a public transport vehicle operator is prohibited. A fine of $500 is assessed for each violation.
- Improper use of a mobile phone by operators 18 and over means one hand has to be on the wheel all the time. Use of a mobile device can in no way interfere with driving. 1st offense means a $35 fine.
If a driver who caused an injury accident violated the Safe Driving Law and was cited for it, that citation could be used to help prove fault and validate your claim.
