    Medical Malpractice / Wrongful Death Claim – $3.85 Million Settlement

    Our law firm represented the family of the decedent, a 34-year-old man, who had been diagnosed with and tragically passed away from Bicuspid Aortic Valve Disease (BAVD), a congenital heart condition that results in the narrowing of the aortic valve.

    This condition was diagnosed during a regularly scheduled physical examination that the decedent underwent. Upon learning of his diagnosis, the decedent followed up with a cardiologist, who he treated with over the course of five years. The cardiologist monitored his BAVD and noted how the decedent would eventually require aortic valve replacement surgery.

    However, the cardiologist continued to delay in proceeding with this necessary, lifesaving aortic valve replacement surgery, even in light of diagnostic evidence exhibited by the decedent’s quickly narrowing aortic valve. The failure of the cardiologist to proceed with the lifesaving aortic valve replacement surgery was the direct and proximate cause of the decedent’s tragic and untimely death.

    We obtained a $3,850,000.00 settlement on behalf of the decedent’s widow and his two young children.

    The settlement award represents a sum to compensate the family for their husband and father’s financial support over his lifetime and to compensate his wife and children for the loss of companionship, society and guidance.

    Wrongful Death of Child in Drunk Driving Accident – $3.1 Million Settlement

    Our firm represented the father of a 4-year-old boy who suffered fatal injuries when the vehicle in which he was a passenger was rear ended by a car operated by a drunk driver.

    Prior to the accident, the intoxicated driver was drinking at a local restaurant. We established that the driver was over-served by the bartender who knew or should have known that he was intoxicated but continued to serve him drinks. Following impact the decedent was ejected from his vehicle, sustaining fatal injuries.

    We obtained a $3.1 million dollar settlement for the surviving parents. The majority of the funds were paid by the insurance company for the restaurant.

    The award represents a sum to compensate to the parents for emotional distress and loss of the society and companionship of their son.

    Drowning Death of 16-Year-Old Boy – $1 Million Settlement

    A 16-year-old boy died as a result of a drowning accident in a tidal river due to a school’s negligence.

    How Did the Accident Occur?

    The teenager was a student at a prep school which allowed its students to swim in a tidal river without supervision. The school did not provide lifeguards or lifesaving equipment. The student tragically drowned while in the river.

    The Wrongful Death Case

    The boy’s mother sued the school for the wrongful death of the boy and was awarded a $1,000,000 settlement. Her son was an inner city kid on scholarship at the prep school, and was known as an outstanding student athlete. He would have been the first member of his family to attend college.

    Wrongful Death of Teenage Girl – $855,000 Settlement

    An 18-year-old girl died from a head injury sustained in a golf cart rollover accident.

    What Happened

    The teenage girl was a golf cart passenger who was fatally injured when the golf cart rolled over. The force of the impact caused the girl to strike her head on the road surface and sustain a traumatic head injury.

    Liability Issues

    The golf cart was one of the many supplied to purchasers of the condominium at a lakeside resort to be used by owners as means of local transportation.

    The golf cart had been modified by the addition of two rear seats. The golf cart rolled over because the added extra seats impacted the gravity center of the cart, making it more prone to rollovers.

    As a result of this accident, the young victim lost her life due to injuries sustained when the cart rolled over. Our clients were the parents the teenage girl who received a settlement of $855,000 for the wrongful death of their loved one. The manufacturer’s modifier and retailer of the golf cart contributed to the settlement.

    Wrongful Death of Passenger in Motorcycle Accident – $450,000 Settlement

    Our client was operating his motorcycle on a highway with his wife as a passenger when they were cut-off by a vehicle. In order to avoid a collision, our client changed into another lane, where he then impacted with a stopped vehicle that was blocking the lane.

    Both our client and his wife were ejected from the motorcycle upon impact. Our client sustained extensive injuries, including a fractured left scapula, fractured right arm, fractured ribs, a spinal fracture, lacerated spleen and left kidney, fractured right hip and a laceration to his right eyelid. His wife sustained fatal injuries and died as a result of the collision.

    Our firm represented the operator of the motorcycle for his personal injury claim as well as the family on behalf of his late wife in a wrongful death claim. We were able to obtain a total settlement of $450,000.00 for the maximum insurance coverage available for both cases.

    Fatal Injuries from Motorcycle Accident – $270,000 Settlement

    A driver’s negligence resulting in a motorcycle accident lead to the wrongful death of a 52-year-old motorcyclist.

    What Happened

    The motorcyclist was traveling on his Harley Davidson motorcycle when he was cut off at an intersection by a senior driver in a car making a left turn without warning.

    As the motorcyclist tried to avoid a collision, he was ejected from his motorcycle and flew over the car, landing yards away. He sustained fatal motorcycle crash injuries and died as a result of this motor vehicle accident.
