What Happened
This condition was diagnosed during a regularly scheduled physical examination that the decedent underwent. Upon learning of his diagnosis, the decedent followed up with a cardiologist, who he treated with over the course of five years. The cardiologist monitored his BAVD and noted how the decedent would eventually require aortic valve replacement surgery.
However, the cardiologist continued to delay in proceeding with this necessary, lifesaving aortic valve replacement surgery, even in light of diagnostic evidence exhibited by the decedent’s quickly narrowing aortic valve. The failure of the cardiologist to proceed with the lifesaving aortic valve replacement surgery was the direct and proximate cause of the decedent’s tragic and untimely death.
